Couples with mixed immigration statuses request that the court lift the suspension of Biden's road to citizenship program.

The court is being asked to allow the Biden administration’s Keeping Families Together program for undocumented spouses to continue, according to couples hoping to participate in it. Launched in August, the Keeping Families Together program is believed to offer a path to citizenship to about 500,000 undocumented individuals married to U.S. citizens. However, the program was put on hold a few days later after Texas and other states led by Republicans sued, claiming it would negatively impact their states’ finances. Since the program was temporarily halted by an appeals court, applications have been blocked. On behalf of the 11 program applicants, attorneys from the Justice Action Center and Make the Road New York filed a motion requesting that the appeals court remove the administrative hold imposed by the Texas district court, claiming that it has extended beyond its permitted duration. Election Day, November 5, is the case’s first court date.
