As administration officials got ready to put the law into effect, CNN previously reported that the authority was being extensively discussed at a number of agencies. Even if the administration cites threats from gangs or cartels, legal experts believe it would be hard for Trump to utilize the act when the US isn’t being attacked by a foreign government. According to the Brennan Center, the Alien Enemies Act has been used three times in US history, all during times of war. It used as justification for the imprisonment and expulsion of German, Austro-Hungarian, Italian, and Japanese immigrants during World Wars I and II. The nonpartisan law and policy organization claims that the statute contributed to the notorious US policy of incarcerating Japanese people during World War II.
