A standing order that prevents the government from deporting undocumented immigrants for at least one day following their filing a legal challenge to their detention prompted the Justice Department to take an extraordinary legal action against the entire federal judiciary in Maryland on Tuesday. As courts nationwide attempted to handle a surge of emergency cases contesting the Trump administration’s aggressive efforts to deport undocumented immigrants, the U.S. District Court for the District of Maryland issued the standing order last month. The most well-known of those cases, featuring Kilmar Abrego Garcia, who was mistakenly deported to El Salvador and returned to the United States this month to face federal charges of illegally trafficking undocumented immigrants, took place in a federal court in Maryland. Technically, no judge in the district can supervise the action because of the unique decision to sue every member of Maryland’s federal judiciary. In an effort to resolve that matter, DOJ filed a motion on Wednesday asking that the case be moved to the Fourth Circuit Court of Appeals and that all district judges disqualify themselves from it.
