Steps to Take if Your I-485 Was Denied
What to do if your I-485 was denied for lack of the J-1 visa no objection letter?
Let’s say you have a problem with your I-485 adjustment of status application, which was denied. The denial letter mentions the need for a no-objection letter related to your J-1 visa. This is crucial because the 212 stamp on your passport indicates a two-year restriction.
Steps to follow:
1
Apply for the no objection letter
You must submit an application of approximately five pages to the embassy or consulate of your country of nationality.
2
Submit a request to the Department of State
This must be done simultaneously with the application to the embassy.
In a recent case, this process took about four months. Once the State Department approves the application, they automatically send the approval letter to USCIS. After this, we can proceed to send the Adjustment of Status (AOS) package.
