Supreme Court Reviews Birthright Citizenship

On May 15, while courts examine whether President Donald Trump’s modifications to birthright citizenship are constitutional, the Supreme Court debated whether to allow them to be widely implemented.  Compared to attorneys representing the states and activists for immigrants’ rights contesting Trump’s executive order, the justices appeared to ask more difficult questions of the Trump administration’s attorneys. However, they also looked into potential alternatives to the nationwide injunctions issued by district courts, which halt the order while it is being challenged. Trump cannot execute the policy while the litigation is pending because federal district courts nationwide have determined that it will probably be declared illegal once it is fully litigated. The Trump administration contends that only those contesting the president’s executive order can have the order he signed on his first day back in office halted.
