SCOTUS Narrows Birthright Policy Blocks
On Friday, the Supreme Court delivered a victory to the Trump administration by permitting it, at this time, to proceed with actions aimed at terminating automatic birthright citizenship. In a 6-3 decision, the court approved a request from the Trump administration to limit the reach of nationwide injunctions issued by judges so that they pertain only to states, organizations, and individuals who filed lawsuits. This suggests that the proposal for birthright citizenship may progress partially, although details are yet to be clarified and it might still face obstruction by courts on different grounds. The decision quickly elicited reactions from plaintiffs who have taken legal action to challenge the executive order, with their attorneys pledging to persist in the legal battle. Hours after the ruling, one set of plaintiffs submitted an amended lawsuit, and the American Civil Liberties Union initiated a new class-action suit. The ruling did not address the legal strengths of Trump’s proposal. However, the administration is expected to gain on several levels as it can now aim to restrict additional nationwide injunctions that lower courts have placed on various assertive executive branch matters, such as attempts to reduce the size of the federal government.
