Applying for a Waiver
If I apply for a waiver, will I have to leave the country and return before I get my green card?
If you are in the U.S. and need to apply for a waiver or “pardon,” you are probably wondering when you will be able to get your permanent residency. Here is the process:
Step 1: File a Petition
First, you must file a petition. This process generally takes between 8 and 12 months, although it may take a little longer.
Step 2: Apply for I-601A Waiver
Next, you must apply for the I-601A waiver. There are a few other steps to follow, but this is the main one. Once your waiver is approved, you will need to upload the documents to the government portal and wait for the visa interview.
Visa Interview
The visa interview will take place in your country of nationality, i.e. outside the U.S. After the interview, you will be required to pay a fee of $220. This fee is for the production of the green card, which will be mailed to the address you designate in the U.S.
