Supreme Court Says Trump Must Help Return Wrongfully Deported Man to El Salvador

On Thursday, the Supreme Court ordered the administration of President Donald Trump to “facilitate” the return of a Maryland man who had been wrongfully deported to El Salvador, but it did not order the government to bring him back to the United States. The administration must attempt to repatriate Kilmar Armando Abrego Garcia, a Salvadoran national who was deported on March 15, the top court said. It stated that a portion of the lower court’s ruling mandating that the government “effectuate” his return was ambiguous and required additional examination. The administration was not given a timeframe by the court to return Abrego Garcia. There were no dissenting views expressed, and the opinion was not signed. The Supreme Court gave Trump a partial victory on Tuesday, permitting him to keep using the contentious Alien Enemies Act while also mandating that officials notify those who might be affected by it so they can try to have their case heard by a judge. The practical implementation of such is still unclear. The Supreme Court left open the specifics of how lower courts should handle those procedures and how much notice inmates should get. Additionally, the Supreme Court’s decision left open the question of what would happen to those who had already been deported under the legislation.
