Supreme Court Allows Bias Against Latinos
The use of racial profiling by ICE in its immigration operations in Los Angeles is evident, yet the Supreme Court upheld the practice by temporarily removing the limitations placed on agents by lower courts.
This enables the Trump administration to carry out indiscriminate raids and arrests based on a variety of criteria, including a person’s work, language, whether they speak English with an accent, race or ethnicity, or where they were when the raid occurred.
This not an absolute decision. The matter returns to the Supreme Court for a merits determination after the top court halted Frimpong’s decision while the case is still pending.
Previousy Judge Maame Ewusi-Mensah Frimpong of the Central District of California had ruled that ICE officers must have a “reasonable suspicion” that a someone is undocumented.
This suspicion cannot be based just on the individual’s skin color or Spanish proficiency. Thus, although a case brought by civil rights organizations, individuals, and permitted residents who were held during Trump’s widespread raids is being heard by the courts, the court has prohibited cops from practicing racial profiling.
