Can my mom be disqualified from I-485 due to the public charge rule, despite my income?
A client encouraged her mom to come to the United States on a tourist visa. She is now here caring for her baby, but has no employment, education or skills beyond caring for her grandchild. They are concerned about whether this could be a problem with the public charge rule for their residency.
And it is understandable that they are concerned, however, this may not be an impediment to them obtaining U.S. residency. During President Trump’s first term, there was an attempt to implement a point system similar to some European countries, but many, including myself, did not support that idea.
As for public charge, USCIS considers cash assistance and long-term institutionalized programs at the state or local level. However, not all immigrants are eligible for these benefits, so it may not be an issue.
