Last fall, we were contacted by a businesswoman who had recently been denied an L-1A visa. She had filed for the visa without an attorney, ultimately leading to the denial. An L-1A visa allows foreign employers to send an employee to the United States as an executive or manager on a temporary basis in order to establish a new office. Our client is the co-founder and executive of a 3D printing business in China and was seeking to expand her business in the United States by establishing a new U.S. office.

 

Our experienced attorneys guided this client to produce a business plan for the new U.S. office, register the business, and demonstrate its legal connection to its Chinese counterpart. Additionally, we addressed a key part of the L-1A visa by showing that our client possessed the necessary executive knowledge and experience to establish the U.S. office. 

 

Due to her previous denial, our client was issued a Request for Evidence (“RFE”) requesting more documentation and evidence of her eligibility for the L-1A visa. We worked diligently with our client to address every individual aspect of the RFE and make strong legal arguments for her eligibility. 

 

Ultimately, just one month after filing the RFE response, our client was approved for the L-1A visa. Now, she is expanding her business ventures in the U.S., and her children can continue their education here in the U.S.
