Can You Expedite Your Immigration Petition in 2025?

Do you have a pending petition—perhaps one filed by your U.S. citizen spouse or adult child (age 21 or older)—and you’re thinking, “I really need to get to America as soon as possible”?

Maybe there’s a major life event coming up, like a wedding, but your case is still sitting in USCIS’s queue. If so, here’s what you need to know:

Expedite requests became more common during the COVID-19 pandemic in 2020. Surprisingly, they are still available in 2025, though they are granted on a limited basis and only in specific circumstances.

 

Which Forms Can Be Expedited?

USCIS may allow expedite requests for:

  • Form I-130 (Petition for Alien Relative)
  • Form I-765 (Application for Employment Authorization)
  • Form I-131 (Advance Parole / Reentry Permit)
  • Form I-485 (Application to Adjust Status) is generally not eligible for an expedite request unless there is a highly unusual or urgent humanitarian reason.

Qualifying Reasons for Expedite Requests

According to USCIS policy, your request must meet at least one of the following criteria:

  1. Severe financial loss to a person or company
  2. Emergency situations
  3. Urgent humanitarian reasons
  4. Clear USCIS error
  5. Nonprofit organization whose request is in furtherance of cultural or social interests of the United States
  6. Compelling U.S. government interests

Keep in mind: personal events such as weddings or family gatherings typically do not qualify on their own.

Examples of Successful Expedite Requests

Here are a few real-world examples from our clients:

  • Medical complications: A client experienced postpartum complications. We successfully expedited her spouse’s I-130 and coordinated an expedited visa interview through the National Visa Center. Both were completed in under a month.

     

  • Government error: In one case, a USCIS notice was sent to the wrong recipient. We pointed out the agency’s error, and the petition was approved within 30 days.
  • Job loss: One client was terminated from their job and provided proper documentation. USCIS approved their work permit (I-765) in less than 30 days due to the financial hardship.
