Court Rules USCIS Violated Law by Failing to Decide on Petitions
U.S. District Court for the Central District of California found that USCIS’s “tolling” regulations were not in accordance with the Trafficking Victims Protection Reauthorization Act of 2008’s (TVPRA) 180-day deadline for the adjudication of Special Immigrant Juvenile (SIJ) petitions, and issued declaratory relief, but not injunctive relief. The court also concluded that the tolling provisions were arbitrary and capricious to the extent that they allowed for violation of the 180-day deadline.
