DC Police to Share Data with Federal Immigration Agents

As President Donald Trump continues his federal takeover of law enforcement in the nation’s capital and his crackdown on illegal immigration, Washington, DC, Police Chief Pamela Smith signed an executive order Thursday permitting DC police officers to share information about individuals not in their custody with federal immigration enforcement agencies like ICE.  In addition, the order permits DC police to help federal law enforcement organizations in transporting detainees and staff and to provide information in instances such as traffic stops. The order does, however, still forbid officers from searching police databases only for an individual’s immigration status, from asking about an individual’s immigration status “for the purpose of determining whether they have violated the civil immigration laws or for the purpose of enforcing civil immigration laws,” and from making an arrest based solely on federal immigration warrants, citing DC law and the police code of conduct. Additionally, DC police are not permitted to interview anyone under their custody or divulge any information about them to federal immigration enforcement authorities.
