DOJ Targets Illinois Immigration Bill

DOJ Targets Illinois Immigration Bill

The Justice Department sued Illinois Governor JB Pritzker (D) and Attorney General Kwame Raoul (D) on Monday, contesting a state law intended to restrict the reach of federal immigration action and shield citizens from agents’ unconstitutional actions during civil immigration enforcement. People have the right to sue anybody who intentionally breaches the U.S. or Illinois constitutions when enforcing civil immigration laws according to the Illinois Bivens Act.

In light of worries about the harsh methods employed during increased federal immigration enforcement in Illinois, it seeks to give people legal redress. Anyone attending state court hearings in good faith is prohibited from being arrested for civil immigration offenses at courthouses under the Court Access, Safety, and Participation Act.
