Judge Blocks ICE Funding Requirement

The Trump administration’s attempt to require almost two dozen, primarily Democratic states to collaborate with federal immigration officials in order to obtain billions of dollars in transportation funds was halted by a federal judge on Thursday. Sean Duffy, the secretary of transportation, issued a warning in April that his department would stop awarding funding to recipients who do not “cooperate generally with Federal authorities in the enforcement of Federal law” as part of a larger campaign to counter “sanctuary” counties. Twenty states filed a lawsuit, claiming the administration lacked the legal right to link immigration enforcement to transportation funding, which states depend on for maintaining roads, airports, and other infrastructure. U.S. District Judge John McConnell sided with the 20 plaintiff states on Thursday, granting a preliminary injunction that blocked the government from enforcing the new immigration regulations for “the States and their governmental subdivisions” as the action works its way through court.
